隐私政策——梅赛德斯-奔驰智能互联服务

梅赛德斯-奔驰(中国)有限公司和北京奔驰汽车有限公司以及他们各自的下属公司和关联公司, 包括但不限于戴姆勒股份公司(合称为“梅赛德斯-奔驰公司”)、北京东方和讯智能科技有限公司、 威瑞森车联网(中国)有限公司以及他们的关联公司(合称为“我们”或者“我们的”)致力于保护 您的隐私。我们希望您了解我们有关根据您的车辆所包含的或您另行选择的服务计划提供“梅赛德 斯-奔驰智能互联”个人协助及安全服务(统称为“服务”)而言,如何收集、使用以及披露您的个 人信息。

在提供服务过程中,我们通过以下方式收集个人信息:

(1) 能够接收服务的梅赛德斯-奔驰车辆所含设备; (2) 我们所提供的可用在移动设备上的“梅赛德斯-奔驰智能互联”软件应用程序; (3) 我们微信公众号和支付宝平台上的梅赛德斯-奔驰智能互联官方账户; (4) 我们的客户服务呼叫中心; (5) 我们发送给您的链接至本隐私政策的电邮或短信息,或者与您进行的其他通信;和 (6) 您可能与我们进行的线下业务往来。

在您使用服务之前,请认真阅读并理解本隐私政策。

1. 个人信息

“个人信息”指能够识别您身份或者与可识别个人有关的信息。服务所收集的个人信息包括:

• 姓名 • 性别 • 身份证号 • 邮寄地址 • 电话号码 • 电邮地址 • 车辆数据,包括您车辆的车辆识别码(VIN)、车型、颜色、车型年份、位置、运行数据 (例如剩余油量和里程表读数)以及呼叫信息 • IP地址(我们还可能通过您的IP地址获取您的大致位置) • 支付卡数据 • 微信个人头像,昵称,性别,城市,OpenID • 支付宝OpenID • 服务账户号码/账户的个人密码 • 紧急联系人(姓名和电话号码、与主驾驶人的关系) • 其他驾驶人(姓名和电话号码) • 销售经销商 • 车载语音电话服务用户的联系人名单 • 车辆 MDN • 手持身份证照片 • 机动车登记证

2. 个人信息的收集与使用

 

我们可能以各种方式就我们所提供的服务收集您的个人信息,包括:

 直接向您收集

我们直接向您或者您授权的人士收集个人信息。例如,当您购买或租赁车辆、注册账户、 使用车辆或者我们的应用程序、提出服务请求或者联系客户服务中心时。

 从其他渠道收集

我们可能在您购买或租赁您的车辆或者注册服务时向您的车辆经销商或制造商收集某些个 人信息,在您使用我们服务合作伙伴的任何网站或者使用我们服务合作伙伴支持的服务时 收集某些个人信息,以及从我们的服务合作伙伴处收集某些个人信息,包括通过下述方式, 例如:(i)当您在使用服务过程中获得电子发票时,通过我们电子发票服务提供商的网站收 集,(ii)当您或您的车辆请求或收到呼入/呼出呼叫中心服务时,通过客户服务呼叫中心收 集,(iii)通过与地图或位置有关的服务收集,(iv)通过与服务有关的电信服务提供商收集, (v)当您因车辆相关问题请求帮助时,通过道路救援服务收集,(vi)当必要且与车辆经销商 或者制造商约定时,通过远程更新收集,以及(vii)通过梅赛德斯-奔驰公司运营的 MB应用 程序和远程诊断服务收集。

请注意,有些个人信息对我们向您提供所请求的服务而言是必需的。如果您不提供所要求的信息, 我们可能无法提供有关服务。

如果您针对服务向我们或者我们的服务提供商披露了与其他人有关的任何个人信息,您特此声明, 您有权这样做,而且您有权准许我们根据本隐私政策使用该等信息。

我们为了下述目的收集及使用您的个人信息:

(1) 提供或准备好为您或您的车辆提供服务

 购买或租赁车辆。当您购买或租赁车辆时,如果您打算通过您的车辆经销商或租赁商 向我们进行注册,我们可能向您的车辆经销商或租赁商收集车辆识别码、车辆颜色、 车型、车辆生产编号、客户名称、身份证号、地址、电话号码、电邮地址和个人密码。

 注册账户。您需要向我们注册账户以获得大多数服务。在试用期内,您的车辆经销商 可代表您注册服务。若他们没有为您注册,您可以通过访问您的车辆经销商或者在按 下您车辆上的i-Call按钮后与客服代表通话向我们进行注册。试用期期满后,您可以 通过我们的微信公众号平台、支付宝生活号或通过联系客服代表完成服务续订。在注 册过程中,我们可能会收集我们从您的车辆经销商或制造商处获取的车辆识别码、车 辆颜色、车型、车辆生产编号、客户姓名、身份证号、地址、电话号码、电邮和个人 密码,和/或您在 i-Call 过程中提供给我们的车辆识别码、车辆颜色、车型和车型年份、 客户姓名、性别、身份证号、地址、电话号码、电邮地址、主要联系方式、其他驾驶 人姓名和电话、紧急联系人和电话号码,以及个人密码。您可以随时通过按下 i-Call 按钮与客服代表通话或致电400-898-0050 与我们联系取消您的账户。

 远程车门锁止/解锁。若您需要在没有钥匙的情况下锁止您的车或者您被锁在您的车外 面,我们的客服代表可按照您的要求尽商业上合理努力来远程锁止或解锁您的车门。但 是,在我们试图做出上述行为之前,您需要提供您的姓名和个人密码,或者验证您的


电话号码、地址和身份证号(如果您忘记了您的个人密码)。如果我们未能为您进行 远程锁止或解锁车门,基于您的要求,我们可能会联系道路救援或紧急服务提供者来帮 助您。为了这一目的,我们可能向他们提供您的姓名、电话号码和车辆位置。

 道路救援及道路救援转接服务。为了我们的道路救援中心能够快速为您提供服务以及 获取您的位置,我们可能收集您的姓名、电话号码、车辆位置和车辆描述信息(例如 型号、颜色)。

 紧急救援协助。为了使公共紧急服务人员恰当且快速地与您取得联系以及派出救护车、 交警、警察或者消防人员,我们可能收集您的车辆位置和车辆描述信息(例如车型、 颜色)、您的姓名和联系电话,以及有关紧急状况性质的信息(例如是否有受伤、有 多少人受伤、牵涉多少车辆)。

 碰撞自动求助(“ACN服务”)。当在紧急情况下 ACN服务被触发时(例如由于车辆 碰撞,您车辆的安全气囊弹出时),我们可能记录、监控或跟踪您车辆的位置。为了 使公共紧急服务人员恰当且快速地与您取得联系以及派出救护车、交警、警察或者消 防人员,我们可能收集您的车辆碰撞情况、您的车辆位置和车辆描述(例如车型、颜 色)、您的姓名和联系电话,以及有关紧急状况性质的信息(例如是否有受伤、有多 少人受伤、牵涉多少车辆)。

 被盗车辆定位服务。当您的车辆可使用被盗车辆定位服务并且您报告您的车辆被盗时, 我们可能记录、监控或者跟踪您车辆的位置。为了使您使用这一服务,我们需要您向 当地警察报告车辆失窃并向我们提供警察出具的协查函,该函中将包含诸如车辆识别 码和车牌号等信息。

 自动报警通知服务。当自动报警通知服务被触发时,我们可能记录、监控或者跟踪您 车辆的位置。我们还可能收集主驾驶人的电话号码或者电邮地址,用于发出通知,提 醒客户该项服务已被触发。

 呼叫中心服务。当您联系我们的呼叫中心时,呼叫中心的客服代表(可能由第三方服 务提供商运营)可能记录您车辆的位置、您提出的服务请求的性质和其处理情况,从 而协助恢复车辆、提供紧急服务或者实现其他合法目的。为了评估、维持或者改进服 务质量、解决问题或者提供培训,或者提升及提供服务,我们可能记录并且在符合中 华人民共和国(“中国”)适用法律的情况下监控您与我们客服代表之间的电话通话内 容。我们的客服代表也可能在与第三方的会议中一直保持在线,以帮助完成某一项服 务请求。

 车载无线热点及多媒体信息服务。为了提供这些服务和解决问题,我们可能会收集购 买信息、使用情况和服务结余情况。请注意,此项服务仅适用于某些型号的车辆。

 支付。如果您对我们的服务付费,我们可收集有关您信用卡、签帐卡、借记卡或其他 付款方式的财务信息,包括:付款人开户银行行号、付款人开户银行、借记卡账号、 付款人姓名、银行卡联合组织、银行卡类别、第三方支付平台用户 ID 和第三方支付 平台用户姓名。我们可能自行或者通过第三方(例如银行、微信、支付宝、快钱)验 证该等信息,并从负责您信用卡、签帐卡、借记卡或付款方式的金融机构处接收最新 的账户信息。

 

 实时路况信息服务。我们可能为了及时更新交通状况而记录、监控或者跟踪您车辆的 位置。此项服务仅适用于某些型号的车辆。

 车载语音电话。在服务过程中,可能运用到语音识别软件。该软件可以识别多种语音、 口音、言语模式和词语。为了提供车载语音电话服务,我们可能收集您的电话号码薄 中的信息,包括联系人姓名和联系人电话号码。请注意,此项服务仅适用于某些型号 的车辆。

 微信/支付宝注册。为了管理您的账户以及更好了解您的阅读偏好,我们可能收集您 的微信和支付宝OpenID。

(2) 与您沟通服务以及您的账户事宜

 在试用期期满前,我们将通过目前您在我们处存档的电话号码与您联系并向您发送续 用通知。我们还会将该续用通知以无线消息的形式显示在您车辆的服务操作单元上。

 我们可能通过您车辆上的设备向您提供消息,以此与您沟通服务事宜。我们还可能向 您的电话号码、微信账号、支付宝账号、邮寄或者电邮地址,或者目前在我们处存档 的其他联系信息发送有关车辆或账户的报告或其他信息。如果您出售或转让了您的车 辆,请立即告知我们。否则,我们可能继续通过我们目前存档的联系方式发送有关车 辆或您账户的消息或者其他信息。

(3) 评估及提升服务

我们将使用您的个人信息用于提升或开发车辆或服务,而且出于该目的,我们可能选择 向我们的第三方服务提供商或我们的授权代理披露您的个人信息。

有关您车辆、您车辆性能以及功能使用的某些数据可能被提供给任何梅赛德斯-奔驰公司, 用于梅赛德斯-奔驰公司改进其产品和服务。

(4) 开展市场调研

我们可能将您的个人信息用于分析和研究目的,而且在必要时将与第三方分享信息以实现 该等目的。

个人信息类别:

a. 个人基本信息,包括您的姓名、职位和收入状况等; b. 联系信息,包括手机号、电邮地址、邮寄地址和邮政编码等; c. 人口统计信息,例如您的性别、出生日期、国籍等; d. 调研信息,例如调研开始、终止以及持续时间; e. 驾驶信息,例如驾驶员的驾照号、您当前的以及过去的车辆、车辆喜好等; f. 偏好信息,包括在市场研究中所表现的您的个人观点或喜好; g. 意见和沟通信息,例如您对市场研究所表达的意见中或您与我们进行的沟通或互动中 所包含的个人信息; h. 与我们不时认为必要或适当的市场研究有关的任何其他信息。

 

我们如何使用以上各类个人信息:

我们主要为了以下目的使用上述信息,包括:

a. 为了进一步开发产品和服务(尤其是用户关爱产品和服务),以及制定其他措施来控 制业务运营和流程; b. 通过分析客户反馈提升产品质量以及更改错误。

(5) 向您提供市场信息

我们可能向您发送与服务有关或无关的,关于服务、产品、客户关爱、特价、促销和营销 信息的短信息/彩信。我们依据前一句发送到您手机号或您车辆中设备的商业性短信息/彩 信(指用于介绍、推广商品、服务或者商业投资机会的短信息/彩信),在一个日历月内 就同一主题事项不会超过十(10)条。如果您不想收到我们的商业性短信息/彩信,您可 以根据信息中包含的说明或者拨打 400-898-0050 联系客服代表进行退订。请注意,该等退 订不会影响您接收与提供服务有关的信息的能力。

我们可能使用您的电邮地址向您发送我们认为您可能感兴趣的,与服务有关或无关的,关 于我们服务、产品、客户关爱、特价、促销、与我们的产品或者服务相关的经挑选的第三 方产品、服务或者要约的信息。您从我们处收到的每一封为要约而发出的邮件将会提供一 个取消订阅所有将来来自于我们电邮要约的链接。如果您不想收到该等电邮,您也可以致 电 400-898-0050 联系客服代表。请注意即使您选择不再接收来自于我们的营销电邮,您可 能仍然收到来自于我们有关您的服务、您的账户、您的系统状况以及任何其他服务相关问 题和订单状态更新的邮件,以使我们向您提供最佳的用户体验。

我们可能向您的微信或支付宝账户发送我们认为您可能感兴趣的,与服务有关或无关的, 关于我们的服务、产品、客户关爱、特价、促销、与我们的产品或者服务相关的经挑选的 第三方产品、服务或者要约的微信或支付宝消息和通知。如果您不想收到该等消息或通知, 您可退订我们的官方账户。请注意,即使您选择不接受我们的微信或支付宝消息或通知, 您可能仍然收到来自于我们有关您的服务、您的账户、您的系统状况以及任何其他服务相 关问题和订单状态更新的信息,以使我们向您提供最佳的用户体验。

我们还可能为了提供信息或者营销目的而使用您的姓名、邮寄信息和电话号码与您联系。 如果您不希望我们通过这些途径联系您,请拨打 400-898-0050 联系客服代表。

3. 披露个人信息

为了提供服务,我们可能向以下各方披露您的个人信息:

(1) 向我们的第三方服务提供商披露,以方便其向我们提供服务

我们可能与我们的第三方服务提供商分享您的个人信息,以方便其向我们提供服务。这些 第三方可能包括电信提供商、无线服务提供商、公共安全运营者、紧急人员、拖车公司、 车辆制造商、批发商及经销商、设备及软件生产商、批发商及许可人、内容提供商以及提 供与服务相关的任何服务、设备、内容、功能或设施的任何其他人士或实体、或者参加我 们的营销活动来提供我们客户可能通过我们的营销活动同意订购的增值服务的任何其他人 士或实体。

 

例如,为了向您提供紧急服务,在您要求时或者您车辆设备发出信号表明需要时,我们 可能联系有关紧急人员提供协助,例如警察、消防部门或者紧急事件急救人员,就此我 们可能向有关紧急人员披露您的姓名、性别、电话号码、您车辆的车牌号和车型、颜色 以及位置。

(2) 根据您的要求向第三方披露

我们可能将您的个人信息披露给您指定的人士,以便在紧急情况下进行联系。

我们不会与其他第三方分享您的个人信息或是披露您的个人信息,除非我们已经获得了您明确同 意,或者进行该等分享或者披露是必要或适当的(尤其是当我们负有法律义务或者合法权益需要 这样做时)。我们可能会为了遵守所适用的法律和法规、配合执法机关或者配合公共和政府机关, 而使用及披露您的个人信息,例如响应某一要求或者提供我们认为有必要或适宜的信息。

 像素标签和其他类似技术

像素标签。像素标签(还被称为网络信标和透明GIF)可被用于跟踪服务用户(包括电邮 接收人)的行为、衡量我们市场活动的成功程度,以及编制有关服务使用情况和响应率的 统计数据。

5. 安全

我们寻求使用合理的组织、技术和管理措施来保护我们组织内的个人信息。我们拥有物理、电子 和程序上的保障措施来保护您的个人信息免受丢失、滥用和篡改。例如,我们采用MD5 和 Base64 算法对您的个人信息进行加密。我们还设置了访问控制机制,确保只有经授权的员工才可

 

以访问您的个人信息。我们将与我们的服务合作伙伴签署严格的保密协议,要求其根据我们的指 示和本隐私政策处理个人信息,并采取相关措施保护您个人信息的保密性和安全性。

我们定期在我们的系统上安装漏洞补丁。安全供应商会不定期检查我们系统的安全性,并对潜在 威胁提出解决方案。针对前端用户与我们系统的交互,我们增加了CA API 网关。API 网关具有 SSL 传输、严格访问控制、IP 黑白列表控件、身份认证、防重放和防攻击、多重审计等安全措施, 可以全面保护API 安全调用,并能够实现灵活良好的配额管理和流程控制管理,从而为我们的后 端服务保驾护航。与我们连接的外部系统已经实现双重认证,有效地保护用户的车辆和个人信息。

我们仅在对履行本隐私政策规定目的必要的有限时间内保留您的个人信息,除非法律要求保留更 长时间。遗憾的是,任何数据传输或者存储系统都不能保证100%安全。如果您有理由认为您与 我们的互动不再安全,请立即根据以下“ 联系我们 ”部分所载述的方式通知我们。

如果发生了任何个人信息安全事件触发了法律法规规定的通知要求,我们将立即向您通知下述事 宜:有关安全事件的基本情况以及可能产生的影响、我们已经采取或者将采取应对该事件的措施、 您可以采取的防范及降低风险措施的建议、我们向您提供的补救措施等。我们将及时通过电邮、 信函、电话或者发送通知的方式向您告知事件的进展情况。难以逐一告知相关个体时,我们将以 合理、有效的方式发布公告。同时,我们将按照监管机构的要求,主动报告个人信息安全事件如 何被处理的。

6. 您的权利

如果您想要访问、更改或者删除个人信息、变更您授权和同意的范围、注销您的账户、或者投诉 任何自动决策的结果,您可以根据以下“ 联系我们 ”部分所载述的方式与我们联系。您还可以通过 按下 i-Call按钮来取消整个服务。

为了保护您的目的,我们可能在执行您的请求前需要核实您的身份。

我们会在三十(30)天内回复您的请求。如果您对我们的回复不满意,您可以通过“联系我们”部分 所载述的方式进行投诉。

在某些情况下,我们将无法响应您的请求:

(1) 涉及我们履行法律法规项下的义务的; (2) 与国家安全或者国防事宜直接相关的; (3) 与公共安全、公共卫生或者重大公共利益直接相关的; (4) 与刑事侦查、起诉、审判和执行判决等直接相关的; (5) 我们有证据证明您存在主观恶意或者滥用您的权利的; (6) 不予响应是出于维护您自己或者其他个人的生命、财产等重大合法权益,但又难以取得同 意的; (7) 响应您的请求会对您自己或任何其他个人、组织的合法权益产生严重损害的;或者 (8) 涉及任何商业秘密的。

7. 跨境传输

您的信息将保存在中国。

 

在所适用法律允许的情况下,为了解决服务困难、改进或者开发服务或相关服务,我们可能在我 们设有设施或者我们聘请了服务提供商的任何国家处理您的个人信息。

通过使用服务,您了解您的信息可能被传送到中国之外的国家,包括美国。这些国家的数据保护 规则可能与中国的有所不同。在该等情况下,我们将运用具有约束力的数据保护法律和其他类似 方式来确保您的个人信息得到在中国境内足够同等的保护。

8. 第三方服务

本隐私政策不涉及任何第三方的信息收集、使用、披露、安全政策或做法,包括提供任何服务或 者运营您可能通过本服务访问的任何网站或应用程序的第三方。当任何第三方(包括车辆经销商、 制造商或者其他第三方服务合作伙伴)直接而不是代表我们向您提供服务时,我们对该等第三方 的政策或做法不承担责任。

9. 本隐私政策的更新

我们可自行酌情决定不时变更本隐私政策。本隐私政策顶部标示的“ 最新更新日期 ”表明了本隐私 政策最近修订的日期。当我们在我们的应用程序、微信公众号平台和支付宝平台上的官方账户中 公布经修订后的隐私政策时,所有更新将生效。

未经您明确同意,我们不会减少您在隐私政策项下的权利。您可以在我们的应用程序、我们微信 公众号平台或者支付宝平台上的官方账户中,或者通过致电梅赛德斯-奔驰智能互联联系电话 400898-0050 了解现行政策。我们会向您提供之前版本的隐私政策供您参考。

Mercedes-Benz (China) Ltd., Beijing Benz Automotive Company, and their respective subsidiaries and affiliates, including, without limitation, Daimler AG (collectively, “Mercedes-Benz Companies”), Beijing Oriental Telematics Services Company, Verizon Connect (China) Co., Ltd., and their affiliates (collectively, “we,” “us,” or “our”) are committed to protecting your privacy. We want you to be familiar with how we collect, use, and disclose your Personal Information in connection with provision of the “Mercedes-Benz Connect” personal assistance and safety services (collectively, the “Service” or “Services”) depending on the service plan that is included with your Vehicle or that you have otherwise selected.

 

In the course of providing the Services, we collect Personal Information through: 

 

(7) Equipment contained in a Mercedes-Benz vehicle that is capable of receiving the Services;    (8) The “Mercedes-Benz Connect” software application made available by us for use on mobile devices;  (9) Our Mercedes-Benz Connect official accounts on the public WeChat and Alipay platforms;  (10)Our customer service call centers; (11)Email or SMS messages that we send to you that link to this Privacy Policy or other communications with you; and (12)Offline business interactions that you may have with us.

11. PERSONAL INFORMATION 

 

“Personal Information” refers to information that identifies you as an individual or relates to an identifiable individual. The Services collect Personal Information, including:     

 

• Name • Gender • ID number • Postal address • Telephone number • Email address  • Vehicle data, including your vehicle’s vehicle identification number (VIN), model, color, model year, location, operation data (e.g., oil life remaining and odometer reading), and calling information • IP address (we may also derive your approximate location from your IP address) • Payment card data • WeChat profile picture, nickname, gender, city and OpenID • Alipay OpenID • Service Account number/PIN of account • Emergency contact (name and telephone number, relationship with primary driver) • Secondary driver (name and telephone number) • Sales dealer • Contact list of Hands-free call service users • MDN of vehicles • Handheld ID card photo • Motor vehicle registration certificate

 

12. COLLECTION AND USE OF PERSONAL INFORMATION

 

We may collect your Personal Information in a variety of ways in connection with our provision of the Services, including: 

 

 Directly from you. 

 

We collect Personal Information directly from you or the person authorized by you, for example, when you purchase or lease a vehicle, register an account, use the vehicle or our application, make a request for the Services, or contact customer service centers.

 

 

 From other sources. 

 

We may collect certain Personal Information from your vehicle dealer or manufacturer when you buy or lease your vehicle or register for Services, from your use of any websites of or services supported by our service partners, and from our service partners, including, by way of example, (i) the website of our E-invoice service vendor when you obtain an E-invoice in the course of using the Services, (ii) the customer service call centers when you or your vehicles request or receive inbound or outbound call center services, (iii) mapping or location-related services, (iv) telecommunication service vendors in connection with Services, (v) roadside assistance when you summon help for vehicle-related problems, (vi) remote update when necessary and agreed upon with the vehicle dealer or manufacturer, and (vii) MB-Apps and remote diagnostics managed by Mercedes-Benz Companies.

We collect and use your Personal Information for the following purposes:

 

(6) Providing or preparing ourselves for providing Services to you or your vehicle.

 

 Purchasing or leasing a vehicle. When you purchase or lease a vehicle, we may collect the VIN, vehicle color, model, vehicle production number, customer name, ID number, address, phone number, email address, and PIN from your vehicle dealer or lessor if you intend to register with us via your vehicle dealer or lessor.

 

 Account registration. In order to receive most of the Services, you need to register an account with us. During a trial period, your vehicle dealer may register you for the Services on your behalf. If they have not, you may register with us either by visiting your vehicle dealer or by pressing the i-Call button in your vehicle and speaking with a customer service representative. After the expiration of the trial period, you can complete the service renewal in our public WeChat platform or via our Alipay Official Account in the

 

 

Alipay App, or by contacting a customer service representative. During the registration process, we may collect the VIN, vehicle color, model, vehicle production number, customer name, ID number, address, phone number, email address, and PIN that we have received from your vehicle dealer or manufacturer, and/or the VIN, vehicle color, model and model year, customer name, gender, ID number, address, phone number, email address, primary contact method, secondary driver’s name and phone number, emergency contact and phone number, and the PIN that you provided to us during the iCall. You may choose to cancel your account by pushing the i-Call button or calling us at 400-898-0050 at any time.

 

 Remote door lock/unlock. In the event you need to lock your vehicle without the key or you are locked out of your vehicle, in accordance with your request, our customer service representatives will use commercially reasonable efforts to lock or unlock your vehicle doors remotely. However, you will need to provide your name and PIN or verify your phone number, address, and ID number if you forget your PIN before we will attempt to do so. If we are unable to lock or unlock your doors remotely, we may, at your request, contact roadside assistance or emergency service providers to help you. For this purpose, we may provide your name, phone number, and vehicle location to them. 

 

 Roadside assistance and Roadside Assistance Connection. We may collect your name, contact number, vehicle location and vehicle description (e.g., model, color), for our Roadside Assistance Center to serve you and obtain your location quickly. 

 

 E-call service. We may collect your vehicle location and vehicle description (e.g., model, color), your name and contact number, and information about the nature of emergency (e.g., whether injuries occurred, how many people were injured, how many vehicles were involved) for public emergency service personnel to connect with you and to dispatch an ambulance, traffic police, police or firefighters appropriately and quickly.

 

 Automatic Collision Notification service (“ACN Service”). When the ACN Service is triggered in an emergency (e.g., airbag(s) of your vehicle deploy(s) due to a vehicle collision), we may record, monitor, or track the location of your Vehicle. We may collect the vehicle collision status, and your vehicle location and vehicle description (e.g., model, color), your name and contact number, and information about the nature of the emergency (e.g., whether injuries occurred, how many people were injured, how many vehicles were involved) for public emergency service personnel to connect with you and to dispatch an ambulance, traffic police, police or firefighters appropriately and quickly.

 

 Stolen vehicle location service. When the stolen vehicle location service is available in your vehicle and you report your vehicle as stolen, we may record, monitor, or track the location of your Vehicle. For you to utilize this service, we require you to report the theft to local police and provide us with an official Vehicle Track Request Form issued by the police, which will include information such as VIN and plate number.  

 

 Automatic alarm notification service. When the automatic alarm notification service is triggered, we may record, monitor, or track the location of your Vehicle. We may also collect the main driver’s phone number or email address for the purpose of sending a

 

 

notification to alert the customer that this service has been triggered.

 

 Call center service. When you contact our call centers, customer service representatives at the call center (which may be operated by a third-party service provider) may record the location of your vehicle, and the nature of your service request and the status of its handling, in order to assist in recovering the vehicle, providing emergency services, or for other legitimate purposes. We may record and, subject to the applicable laws of the People’s Republic of China (“China”), monitor telephonic conversations between you and our customer service representatives, in order to assess, maintain, or improve the quality of the Services, for issue resolution or training purposes, or to promote and provide the Services. Our customer service representatives may also remain on the line while conferencing in a third party to assist in completing a service request.

 

 WIFI and multi-media service package. In order to provide these services and for troubleshooting, we may collect purchase information, usage, and balance status of the packages. Note that this service package is only available in certain models of vehicles. 

 

 Payment. If you wish to make a payment for our Services, we may collect certain financial information regarding your credit card, charge card, debit card, or other payment method, including Account holding bank number of payer, Payer account bank, Debit account number, Payer\'s name, association of interoperable bank card service, bank card type, third-parties payment platform user ID, and third-parties payment platform user name. We may verify such information either ourselves or through third parties (e.g., bank, WeChat, Alipay, 99Bill) and receive updated account information from the financial institution responsible for your credit card, charge card, debit card, or payment method.

 

 Live Traffic Service. We may record, monitor, or track the location of your vehicle in order to update traffic status on a timely basis. Note that this service is only available in certain models of vehicles.

 

 Hands-free Call. Voice recognition software may be used in connection with the Service. This software may recognize many voices, accents, speech patterns, and words. In order to provide Hands-free Call service, we may collect your telephone book, including contact name and contact number. Note that this service is only available in certain models of vehicles. 

 

 WeChat/Alipay Registration. We may collect your WeChat and Alipay OpenID for purposes of administering your account and to better understand your reading preferences. 

 

(7) Communicating with you about the Services and your account.

 

 Before the expiration of the trial period, we will contact you at your cell phone number currently on file with us and send you notice for renewal. We will also send the renewal notice as a wireless message that is displayed on the head unit of your vehicle.

 

 We may communicate with you about the Services by providing you with messages

 

 

through the equipment in your vehicle. We may also send reports or other information about the vehicle or the account to your cell phone number, WeChat/Alipay Account, postal or email address, or other contact information currently on file with us. Please promptly notify us if a sale or transfer of your vehicle occurs; otherwise, we may continue to send messages or other information about the vehicle or your account by using the contact information that we have on file.

 

(8) Evaluating and improving the Services.

 

We will use your Personal Information for purposes of improving or developing the vehicles or the Services and, for such purposes, may choose to disclose your Personal Information to our third-party service providers or our authorized agents.

 

Certain data regarding your vehicle, your vehicle’s performance, and feature utilization may be provided to any Mercedes-Benz Company to enable such Mercedes-Benz Company to improve their products and services.

 

(9) Performing market research.

 

We may use your Personal Information for analysis and research purposes and will share information as necessary with third parties to accomplish those tasks.

 

 

Personal Information categories:

 

i. Personal basic information, including your name, occupation, and income status, etc.; j. Contact information, including mobile phone number, email address, postal address, and zip code, etc.; k. Demographic information, such as your gender, birthday, nationality, etc.; l. Survey information, such as the start, end and duration of the survey; m. Driving information, such as your driver\'s license number, your current and past vehicles, preferences for vehicles, etc.; n. Preference information, including your personal views or interests expressed in the market research; o. Comments and communication information, such as the Personal Information contained in your comments on the market research or communications or interactions with us; p. Any other information related to the market research that we deem necessary or appropriate from time to time.

 

How we use your above categories of Personal Information:

 

We use your above information mainly for the following purposes, including:

 

c. To further develop products and services, especially user care products and services, and formulate other measures to control business operations and processes; d. To improve product quality and correct faults by analyzing customer feedback.

 

(10) Providing you with marketing information. 

 

 

 

We may send you SMSes/MMSes about services, products, customer care, specials, and promotional and marketing information, which may or may not be related to the Service. Commercial SMSes/MMSes (meaning SMSes/MMSes for the purpose of introducing or promoting commodities, services, or business investment opportunities) sent to your mobile phone number or the equipment in your vehicle under the preceding sentence with respect to the same subject matter will not be circulated to you more than ten (10) times in a calendar month. If you do not want to receive commercial SMSes/MMSes from us, you may opt out according to the instructions contained therein or contact a customer service representative at 400-898-0050. Please note that such opt out will not affect your ability to receive messages related to the provision of the Services. 

 

We may use your email address to send you information about our services, products, customer care, specials, promotions, selected third-party products, services, or offers relating to our offerings or services that we think may be of interest to you, which may or may not be related to the Services. Each email you receive from us for offers will provide a link to unsubscribe to all future email offers from us. If you do not want to receive such emails, you can also contact a customer service representative at 400-898-0050. Please note that even if you choose not to receive marketing emails from us, you may still hear from us regarding your Services, your account, your system status, and any other service-related issues and order status updates that will allow us to provide you with the optimal user experience.

 

We may send WeChat/Alipay posts and notifications to your WeChat/Alipay account that include information about our services, products, customer care, specials, promotions, selected third-party products, services, or offers relating to our offerings or services that we think may be of interest to you, which may or may not be related to the Services. If you do not want to receive such posts or notifications, you can unsubscribe our Official Account. Please note that even if you choose not to receive WeChat/Alipay posts or notifications from us, you may still hear from us regarding your Services, your account, your system status, and any other Servicerelated issues and order status updates that will allow us to provide you with the optimal user experience.

 

We may also use your name, postal delivery information, and phone number to contact you for informational or marketing purposes. If you do not wish us to contact you by these means, please contact a customer service representative at 400-898-0050.

 

13. DISCLOSURE OF PERSONAL INFORMATION

 

In order to provide Services, we may disclose your Personal Information:

We may share your Personal Information with our third-party service providers, to facilitate services they provide to us. These can include telecommunications providers, wireless service providers, public safety operators, emergency personnel, towing companies, vehicle manufacturers, distributors and dealers, equipment and software manufacturers, distributors, licensors, content providers, and any other person or entity who provides any service, equipment, content, feature, or facilities in connection with the Services or who joins our sales

 

campaign to provide value-added services that our customers may agree to subscribe for through our sales campaign.

 

For instance, in order to provide you with emergency services, we may contact appropriate emergency personnel, such as police, the fire department, or emergency responders, for assistance when you request it or when the equipment in your vehicle signals for it, in connection with which we may disclose your name, gender, phone number, license plate number, and model, color, and location of your vehicle to relevant emergency personnel. 

 

(2) To third parties based on your request.

 

We may disclose your Personal Information to individuals designated by you to be contacted in emergencies.

 

We will not share with other third parties or disclose your Personal Information, unless we have obtained your explicit consent, or such sharing or disclosure is necessary or appropriate, in particular when we have a legal obligation or legitimate interest to do so. We may use and disclose your Personal Information to comply with applicable laws and regulations, to cooperate with law enforcement, or to cooperate with public and government authorities, such as to respond to a request or provide information we believe is necessary or appropriate. 

 

In the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings), your Personal Information may be transferred to a third party. We will ask such third party to continue to observe this Privacy Policy. Otherwise, we will require them to seek for your consent again.

 Cookies.

 Pixel tags and other similar technologies.

 

Pixel tags. Pixel tags (also known as web beacons and clear GIFs) may be used to, among other things, track the actions of users of the Services (including email recipients), measure the success of our marketing campaigns, and compile statistics about usage of the Services and response rates.

 

15. SECURITY

 

We seek to use reasonable organizational, technical, and administrative measures to protect Personal Information within our organization. We have physical, electronic, and procedural safeguards in place to protect against the loss, misuse, and alteration of your Personal Information. For example, we use MD5 and Base64 algorithms to encrypt your Personal Information. We also set up an access control mechanism to ensure that only authorized staff can get access to your Personal Information. We will enter into strict non-disclosure agreements with our service partners to require them to process Personal Information according to our instructions and this Privacy Policy, and take related measures to protect confidentiality and security of your Personal Information. 

 

We regularly install vulnerability patches on our system. The security supplier will check our system security from time to time and recommend resolutions to potential threats. In relation to interactions between front-end users and our system, a CA API gateway has been added. The API gateway has security measures such as SSL transmission, strict access control, IP black-and-white list control, authentication, anti replay and anti attack, multiple audits, etc., which can fully protect API security calls and can implement flexible and fine quota management and flow control management to protect our back-end services. The external systems connected with us have achieved two-way authentication, effectively protecting users’ vehicles and Personal Information.

 

We will only retain your Personal Information for a limited period necessary to fulfill the purposes specified in the Privacy Policy, unless a longer retention period is required by law. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the “Contacting Us” section below.

 

In the case of any Personal Information security incident that triggers a notification requirement in accordance with laws and regulations, we will promptly inform you of the following: basic information about the security incident and the likely impact, what measures we have taken or will take to respond to this incident, suggestions on what measures you may take to guard against and mitigate the risks, remedial actions we provide to you, etc. We will timely brief you on the progress of the incident by email, correspondence, or phone or by sending notifications. When it is difficult to notify relevant individuals one by one, we will release announcements in a reasonable and effective manner. Meanwhile, we will voluntarily report how the Personal Information security incident is handled, as required by the regulator.

If you would like to request to access, correct, or delete Personal Information, change the scope of your authorization and consent, deregister your account, or make a complaint on the results of any automatic decision-making, you may contact us in accordance with the “Contacting Us” section below.

For your protection, we may need to verify your identity before implementing your request.

 

We will respond to your request within thirty (30) days. If you are not satisfied with our response, you may lodge a complaint through methods as specified in the “Contacting Us” section.

 

Under certain circumstances, we will not be able to respond to your request:

 

(9) where our obligations under laws and regulations are involved; (10)where State security or national defense is directly involved; (11)where public security, public sanitation, or major public benefits are directly involved; (12)where investigations into crimes, prosecutions, court trials, execution of rulings, etc. are directly involved; (13)where we have evidence that you have a malicious intent or are abusing your rights; (14)where not responding is for the sake of safeguarding significant legal rights and interests, such as the life and property, of yourself or other individuals, but it is difficult to obtain the consent; (15)where a response to your request will give rise to serious damage to the legal rights and interests of yourself or any other individuals or organizations; or (16)where it involves any trade secret.

 

17. CROSS-BORDER TRANSFER

 

Your Personal Information will be stored in China. 

 

To the extent permissible by applicable law, your Personal Information may be processed in any country where we have facilities or in which we engage service providers, for purposes of resolving service difficulties or improving or developing the Services or related services.

 

By using the Services you understand that your information may be transferred to countries outside of China, including the United States, which may have data protection rules that are different from those in China. We may change this Privacy Policy at any time in our sole discretion. The “LAST UPDATED” legend at the top of this Privacy Policy indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy in our application, and at our official accounts on the public WeChat platform and the Alipay platform.

 

We will not reduce your rights due under the Privacy Policy without your explicit consent.
