您的信任对我们非常重要，江苏云学堂网络科技有限公司（下称“我们”或者“云学堂”）深知个人信息对您的重要性，我们将按法律法规要求，采取相应安全保护措施，尽力保护您的个人信息安全可控。鉴于此，云学堂制定本《云学堂平台隐私政策》（下称“本政策 /本隐私政策”）并提醒您：本政策适用于云学堂平台提供的所有产品和服务。
Your trust and support is very important to us. Jiangsu Yunxuetang Network Technology Co., Ltd. (hereinafter referred to as "we" or "Yunxuetang") is fully aware of the importance of personal information to you, and we do our best to take appropriate security measures to keep your personal information safe and controllable following to regulations. 需要特别说明的是，本政策不适用于其他第三方向您提供的服务，也不适用于云学堂中已另行独立设置隐私政策的产品或服务。例如云学堂上的第三方服务商依托云学堂向您提供服务时，您向第三方服务商提供的个人信息不适用本政策。此外，若您在收听或购买云学堂平台课程时主动或应主播方需求决定提供个人信息的，一切风险、后果及责任由您和主播方自行承担。
Please kindly noted that this Privacy Policy does not apply to other services provided for you by third parties. Meanwhile, it does not apply to other products or services in which a Privacy Policy has been set up independently. For example, this Privacy Policy does not apply to any services provided for you by third parties through Yunxuetang Platform, even if your personal information is provided to such third parties. In addition, if you decide to provide personal information on your own initiative or in response to the needs of the streamer when listening to or purchasing courses on the Yunxuetang Platform, all risks, consequences and responsibilities are borne by you and the streamer.

一、定义
I. definition
个人信息：指以电子或者其他方式记录的能够单独或者与其他信息结合识别特定自然人身份或者反映特定自然人活动情况的各种信息。
Personal information means various information recorded by electronic or other means that can identify the identity of a specific natural person or reflect the activities of a specific natural person alone or in combination with other information.
个人敏感信息：指一旦泄露、非法提供或滥用会危害人身和财产安全，极易导致个人名誉、身心健康受到损害或歧视性待遇等的个人信息。通常情况下，14岁以下（含）儿童的个人信息和涉及自然人隐私的信息属于个人敏感信息。（我们将在本隐私政策中对具体个人敏感信息以粗体进行显著标识）。
Sensitive personal information means any personal information that, once leaked, illegally provided or abused, will endanger personal safety or property safety, easily lead to damage or discriminatory treatment to personal reputation, physical and mental health. Under normal circumstances, the personal information of children under the age of 14 (inclusive) and information involving the privacy of natural persons are personal sensitive information. 个人信息删除：指在实现日常业务功能所涉及的系统中去除个人信息的行为，使其保持不可被检索、访问的状态。

个人信息主体：指个人信息所标识的自然人。

匿名化：指通过对个人信息的技术处理，使得个人信息主体无法被识别或者关联，且处理后的信息不能被复原的过程。个人信息经匿名化处理后所得的信息不属于个人信息。
Anonymization means the process in which the personal information subject cannot be identified or associated through technical processing of personal information, and the processed information cannot be recovered. The information obtained by anonymizing personal information is not personal information.
去标识化：指通过对个人信息的技术处理，使其在不借助额外信息的情况下，无法识别或者关联个人信息主体的过程。
De-identification means the process of technical processing of personal information to make it impossible to identify or associate the personal information subject without additional information.

云学堂平台：指云学堂企业人才服务平台（简称：绚星云学习）。
Yunxuetang Platform means Yunxuetang Enterprise talents services platform, which is referred as Xuanxing Cloud Learning.
用户：为简化描述，在本协议中特指使用云学堂平台的企业授权使用平台并开放账户的员工。您需要理解，云学堂平台的用户实际为企业，而非该企业的员工。但为了便于您理解本隐私协议，在本协议中将上述员工定义为“用户”。
User/Users means the employees who are opened an account and authorized to use Yunxuetang Platform by the enterprise who is provided services by Yunxuetang Platform only in this Privacy Policy. It is kindly noted by you, the actual user/users of Yunxuetang Platform are enterprises who are provided services by Yunxuetang Platform, not any employees of such enterprises. In order to facilitate your understanding of this Privacy Policy, the above-mentioned employees are defined as "user/users" in this policy.
中华人民共和国：指中华人民共和国大陆地区，仅为本隐私政策之目的，不包含香港特别行政区、澳门特别行政区和台湾地区。

1.1.1您的企业在云学堂平台中为您创建账户时，需要根据企业组织架构创建账号的用户名和密码。您在拥有账号后，可在云学堂平台内自行修改密码。岗位、用户名、密码为必要信息。
When your employer creates an account for you on Yunxuetang Platform, it needs to create an account username and password according to the organizational structure of the enterprise, i.e your employer. After your account is created, you can change the password by yourself on Yunxuetang Platform. Work Position, username and password are necessary information for an account.
1.1.2您在使用云学堂平台时，为维护您的基本资料，改善您的服务体验，需要您选择填写和/或完善使用对应服务所需要的信息，包括您的手机号、电子邮箱、性别、所在地、头像、昵称、生日、部门。如您不提供这些信息，并不影响您对云学堂平台功能使用。
When you use Yunxuetang Platform, in order to maintain your basic information and improve your service experience, you need to choose to fill in and/or complete the information required for the use of the corresponding service, including your mobile phone number, email, gender, location, Avatar, nickname, birthday, department. If you do not provide these information, it will not affect your use of the functions of the Yunxuetang Platform.

云学堂平台是一个在线学习APP，为了帮助您访问云学堂平台上的课程及其它学习资源，我们需要使用您的网络（wifi或者蜂窝移动网络）。
Yunxuetang Platform is an online learning APP. In order to help you access courses and other learning resources on the Yunxuetang Platform, we need to use your network, i.e. wifi or cellular network.
1.3为您提供学习社区服务
To provide you with online learning community services
云学堂平台提供学习问答、即时通讯(IM沟通)和笔记等学习工具，当在云学堂平台使用问答、即时通讯(IM沟通)和笔记功能时，您上传的视频、图片、评论、互动信息会存储在云学堂平台的服务器中，因为存储是实现这一功能所必需的。我们会以加密的方式存储，您也可以随时删除自己上传的信息。除非经您自主选择或遵从相关法律法规要求，我们不会对外提供上述信息，或者将其用于该功能以外的其他用途。
The Yunxuetang Platform provides online learning tools such as Q&A, instant messaging (IM communication) and notes. When using the Q&A, instant messaging (IM communication) and note-taking functions on Yunxuetang Platform, the videos, pictures, comments, and interactive information you uploaded will be stored in the servers of Yunxuetang Platform, because such storage is necessary to realize this function. We store it in an encrypted way, and you can delete such documents at any time. Unless you choose or comply with relevant laws and regulations, we will not provide the above documents to third parties, or use it for other purposes than this function.

为了保证您在使用云学堂平台时的基本用户体验，您选择使用云学堂平台学习时，则需要向我们提供或允许我们收集以下设备权限与信息：
In order to ensure basic user experience when you use Yunxuetang Platform, when you choose to use Yunxuetang Platform to learn, you need to provide us or allow us to collect the following device permissions and information.
1.4.1获取您的设备的 WLAN 连接状态，以便在云学堂平台在播放视频课程或直播需要消耗较多数据流量时，能给您及时提醒。
Obtain the WLAN connection status of your device, so that it can remind you in time when more data traffic would be consumed by playing video courses or live stream on Yunxuetang Platform.
1.4.2判断应用运行状态，以判断云学堂平台是否在前台运行，从而根据您的使用场景为您提供合适的通知。

1.4.3改变音量，以方便您在观看或收听音视频课程时可以改变音量。

1.4.4控制振动。当您未打开APP时，收到IM聊天消息或上课通知，通过振动提示。
Control the vibration. When you do not open the APP, you will receive IM chat messages or course notices prompted by vibration.
1.4.5通知中心。当您有上课通知、新的IM消息时，快速得到提醒。
Notification Center. Make you get quick reminders when you have class notification, new IM messages.
1.4.6重力感应。根据手机的方向，视频和直播可以自动横屏，提升您的学习体验。
Gravity sensing. According to the direction of your phone, videos and live stream from Yunxuetang Platform can be automatically landscaped to enhance your learning experience.
1.4.7本地数据库写入与读取。当您观看视频课程时，可以缓存视频文件至您的手机，以便您离线时观看学习。
Local database write and read permissions. When you watch a video course, you can cache the video file to your phone so that you can watch and learn offline.
1.4.8检测本机是否安装微信、QQ。为了方便您采用微信、QQ的第三方账号登录和分享学习内容，我们使用了第三方SDK“微信分享SDK”，微信分享SDK需要监测您是否安装了相应APP，以调用微信、QQ进行分享和登录。
To check whether WeChat and QQ are installed on your device. In order to facilitate you to log in and share learning content with the third-party accounts of WeChat or QQ, we use the third-party SDK "WeChat Sharing SDK". The WeChat Sharing SDK needs to monitor whether you have installed the corresponding APP to call WeChat or QQ to share and Log in.
1.4.9手机休眠。为了让您在学习视频过程中，避免因手机自动休眠造成学习打断，我们需要使用手机休眠功能，让视频学习过程不被休眠打断。

1.4.10应用新版本安装提醒。为了提升您的学习体验，云学堂平台将持续进行在线升级，我们会在应用内提醒您下载和安装最新版本的APP。
Application new version installation reminder. In order to improve your learning experience, Yunxuetang Platform will continue to be upgraded online. We will remind you to download and install the latest version in Yunxuetang App.
1.4.11取消推送消息。为了避免消息频繁推送，您可以在登陆APP后通过“我的-设置与反馈-新消息通知”设置是否推送。
Cancel push message. In order to avoid frequent push of messages, after you log in Yunxuetang APP, you can set whether to push through "My - Settings and Feedback - New Message Notification" Menu.
1.4.12获取安装APP列表。我们需要获取当前系统安装的APP签名与当前APP作对比，确保您的APP是官方APP，该信息只在本机存储及应用。
Get the App list. We need to obtain the APP signature installed in the current system and compare it with the current APP to ensure that Yunxuetang APP in your device is an official APP. This information is only stored and applied locally.
1.4.13获取当前运行的APP进程列表。获取当前运行的APP进程名字与当前APP包名进行对比确保主进程执行了必要的代码，该信息只在本机存储及应用。

1.4.14为确保您获得更为流畅、轻松的使用体验， 在您使用云学堂提供的相关服务时， 我们会通过小型数据文件“Cookie”识别您的身份， 以帮助您减少信息录入的次数和频率，或协助判断您账户的安全状况。Cookie通常包含标识符、站点名称以及一些号码和字符，借助于Cookie，网站能够存储您的偏好信息用于改善产品服务及用户体验，或及时发现并防范安全风险，为您提供更好的服务。我们不会将Cookie用于本政策所述目的之外的任何用途，您可根据自己的偏好留存或删除Cookie。您可清除软件内保存的所有Cookie，当您手动清除后您的相关信息即已删除。

当您在使用云学堂平台的过程中遇到系统崩溃情况时，我们在经过您的同意后需要您授权读取手机状态和身份，包括手机设备类型、系统版本、MAC地址、IMEI以便快速定位并为您解决相应问题。
请注意，单独的设备信息、系统版本信息是无法识别特定自然人身份的信息。
When you encounter a system crash in the process of using Yunxuetang Platform, we need your authorization to read the mobile phone status and identity after your consent, including the mobile phone device type, system version, MAC address, IMEI to quickly locate and Solve the corresponding problem.
Please be kindly noted that separate device information and system version information are information that cannot identify a specific person.
1.6其它附加服务

为向您提供更便捷、更优质、个性化的产品及/或服务，努力提升您的体验，我们在向您提供的以下附加服务中会收集和使用您的个人信息。如果您不提供这些信息，不会影响您使用云学堂平台的浏览、搜索、购买基本服务，但您无法获得这些附加服务给您带来的用户体验。这些附加服务包括：
In order to provide you with more convenient, high-quality and personalized products and/or services and strive to improve your experience, we will collect and use your personal information in the following additional services provided to you. If you do not provide these information, it will not affect Yunxuetang Platform’s basice services, such as browsing, searching, and purchasing services, but you will not be able to obtain the user experience that these additional services bring to you. These additional services include as following:
1.6.1基于相机/摄像头的附加服务。您可在开启相机/摄像头权限后使用该功能进行扫码用于登录、扫一扫、签到、拍摄照片或视频用于和其他用户之间的交流。
Camera-based additional services. After enabling the camera permission in your system, you can use this function to scan the code to log in, scan, sign in, take photos or videos for communication with other users.
1.6.2基于相册（图片库/视频库）的图片/视频访问及上传的附加服务。您可在开启相册权限后使用该功能上传您的图片/视频，以实现更换头像、更换背景、上传时刻/社区图片、在即时通讯(IM沟通)中发送图片。
Additional services for photo/video access and upload based on photo albums (photo library/video library). You can use this function to upload your photo/videos after enabling the album permission to change avatars, change backgrounds, upload moment/community pictures, and send photos in instant messaging (IM communication).
1.6.3基于麦克风的语音技术相关附加服务。您可在开启麦克风权限后使用麦克风实现和其它用户之间进行语音聊天以及语音搜索功能。请您知晓，即使您已同意开启麦克风权限，我们也仅会在您主动点击客户端内麦克风图标或录制视频时通过麦克风获取语音信息。
Additional services related to microphone-based speech technology. After enabling the microphone permission, you can use the microphone to implement voice chat with other users and voice search functions. Please be kindly noted that even if you have agreed to enable the microphone permission, we will only obtain voice information through the microphone when you actively click the microphone icon or record a video in the App.
1.6.4基于位置的相关附加服务。您可以在开启位置权限后获取手机GPS用于时刻、社区、签到的定位，拒绝后定位信息将受到影响，基于位置的签到功能将无法使用。
Location-based additional services. After you enable the location permission, you can obtain the GPS of your phone for time, community, and check-in positioning. If you refuse, the positioning information will be affected, and the location-based check-in function will not be available.
1.6.5基于电话的相关附加服务。您可以在开启来电状态的监听权限后在音视频知识学习中避免电话来电避免影响学分记录以获得更好的学习体验。
Phone-based Additional Services. You can avoid phone calls in learning audio and video courses after enabling the monitoring permission of the incoming call status to avoid affecting the credit record for a better learning experience.
1.6.6基于存储的相关附加服务。您可以在开启存储权限后将课件内容缓存到本地方便后续离线学习，以及获得相关系统错误日志的记录能力。
Storage-based additional services. After enabling the storage permission, you can cache the courses content locally to facilitate subsequent offline learning and obtain the ability to record related system error logs.
请您理解并同意，上述附加服务需要您在您的设备中开启您的摄像头（相机）、相册（图片库）、麦克风（语音）、日历、位置、电话和存储的访问权限，以实现这些权限所涉及信息的收集和使用。您可在您的设备设置中逐项查看上述权限的状态，并可自行决定这些权限随时的开启或关闭。请您注意，您开启任一权限即代表您授权我们可以收集和使用相关个人信息来为您提供对应服务，您一旦关闭任一权限即代表您取消了授权，我们将不再基于对应权限继续收集和使用相关个人信息，也无法为您提供该权限所对应的服务。但是，您关闭权限的决定不会影响此前基于您的授权所进行的信息收集及使用。
Please kindly understand and agree that the above additional services require you to turn on your camera, photo album, microphone (voice), calendar, location, phone and storage access permissions in your device in order to achieve collection and use of the information involved these permissions. You can check the status of the above permissions item by item in your device settings, and decide whether to turn these permissions on or off at any time. Please be kindly noted that if you open any permission, you authorize us to collect and use relevant personal information to provide you with corresponding services. Once you close any permission, it means that you cancel the authorization, and we will no longer continue to collect and use elated personal information based on the corresponding permission, meanwhile the services corresponding to this permission can not be provided. However, your decision to close the permission will not affect the previous collection and use of information based on your authorization.

1.7.1若您提供的信息中含有其他用户的个人信息，在向云学堂平台提供这些个人信息之前，您需确保您已经取得合法的授权。若其中涉及儿童个人信息的，您需在发布前取得对应儿童监护人的同意，前述情形下监护人有权通过本政策第九条的途径联系我们，要求更正或删除涉及儿童个人信息的内容。
If the information you provide contains personal information of other users, you must ensure that you have obtained legal authorization before providing such information to Yunxuetang Platform. If it involves minor's personal information, you need to obtain formal consent of the corresponding minor's guardian before publishing. In the above-mentioned circumstances, the guardian has the right to contact us through the means of Article 9 of this policy to request correction or deletion of the content involving minor's personal information.
1.7.2若我们将信息用于本政策未载明的其他用途，或者将基于特定目的收集而来的信息用于其他目的，或者我们主动从第三方处获取您的个人信息，均会事先获得您的同意。
If we use the personal information for other purposes not specified in this policy, or use the information collected for a specific purpose for other purposes, or if we actively obtain your personal information from a third party, we will obtain your consent in advance.
若我们从第三方处间接获取您的信息的，我们会在收集前明确以书面形式要求该第三方在已依法取得您同意后收集个人信息，并向您告知共享的信息内容，且涉及敏感信息的在提供给我们使用前需经过您的明确确认，要求第三方对个人信息来源的合法性和合规性作出承诺。如第三方有违反行为的，我们会明确要求该第三方承担相应法律责任；同时，我们的专业安全团队对个人信息会进行安全加固（包括敏感信息报备、敏感信息加密存储、访问权限控制等）。我们会使用不低于我们对自身用户个人信息同等的保护手段与措施对间接获取的个人信息进行保护。
If we indirectly obtain your information from a third party, we will explicitly request the third party in writing to collect your personal information after obtaining your consent in accordance with the law and inform you of the content of the shared information before such collection. If it involves sensitive personal information, it needs to be clearly confirmed by you before providing it to us for use. 您充分理解并同意，我们在以下情况下收集、使用您的个人信息无需您的授权同意，且我们不会响应您提出的更正/修改、删除、注销、撤回同意、索取信息的请求：
Please kindly understand and agree that in the following cases we do not need your authorization to collect and use your personal information, and we will not respond to your requests for correction/modification, deletion, cancellation, withdrawal of consent, request for information.
（1）与国家安全、国防安全有关的；
（2）与公共安全、公共卫生、重大公共利益有关的；
（3）与犯罪侦查、起诉、审判和判决执行等司法或行政执法有关的；
（4）出于维护您或其他个人的生命、财产等重大合法权益但又很难得到本人同意的；
（5）您自行向社会公众公开的个人信息；
（6）从合法公开披露的信息中收集个人信息的，如合法的新闻报道、政府信息公开等渠道；
（7）根据与您签订和履行相关协议或其他书面文件所必需的；
（8）用于维护所提供的产品及/或服务的安全稳定运行所必需的，例如发现、处置产品及/或服务的故障；
（9）为合法的新闻报道所必需的；
（10）学术研究机构基于公共利益开展统计或学术研究所必要，且对外提供学术研究或描述的结果时，对结果中所包含的个人信息进行去标识化处理的；
（11）法律法规规定的其他情形。

本政策的生效、履行、解释及争议的解决，您因使用云学堂平台或服务而产生或与本政策相关的一切争议、权利主张或其他事项，均适用中华人民共和国法律。您与云学堂或云学堂平台发生的一切争议，应友好协商，如协商不成的，可选择提交云学堂注册所在地人民法院（即：苏州市高新区(虎丘区)人民法院）诉讼管辖。
It shall be governed by the laws of the People's Republic of China for the effectiveness, performance, interpretation and dispute resolution of this Privacy Policy, and all disputes, claims or other matters arising from your use of Yunxuetang Platform or services or related to this Privacy Policy. All disputes between you and Yunxuetang or the Yunxuetang Platform should be negotiated amicably. 一、定义
个人信息：指以电子或者其他方式记录的能够单独或者与其他信息结合识别特定自然人身份或者反映特定自然人活动情况的各种信息。
个人敏感信息：指一旦泄露、非法提供或滥用会危害人身和财产安全，极易导致个人名誉、身心健康受到损害或歧视性待遇等的个人信息。通常情况下，14岁以下（含）儿童的个人信息和涉及自然人隐私的信息属于个人敏感信息。（我们将在本隐私政策中对具体个人敏感信息以粗体进行显著标识）。
个人信息删除：指在实现日常业务功能所涉及的系统中去除个人信息的行为，使其保持不可被检索、访问的状态。
个人信息主体：指个人信息所标识的自然人。
关联公司：指我们的关联公司、投资公司、集团公司成员。
匿名化：指通过对个人信息的技术处理，使得个人信息主体无法被识别或者关联，且处理后的信息不能被复原的过程。个人信息经匿名化处理后所得的信息不属于个人信息。
去标识化：指通过对个人信息的技术处理，使其在不借助额外信息的情况下，无法识别或者关联个人信息主体的过程。

1 我们如何收集和使用您的个人信息
云学堂仅会出于本政策所述的以下目的，收集和使用您的个人信息：
1.1 为您提供用户创建、资料维护服务
1.1.1 您的企业在云学堂平台中创建账户时，需要根据企业组织架构创建账号的用户名和密码。您在拥有账号后，可在云学堂平台内自行修改密码。岗位、用户名、密码为必要信息。
1.1.2 您在使用云学堂平台时，为维护您的基本资料，改善您的服务体验，需要您选择填写和/或完善使用对应服务所需要的信息，包括您的手机号、电子邮箱、性别、所在地、头像、昵称、生日、部门。如您不提供这些信息，并不影响您对云学堂平台功能使用。
1.2 为您提供在线学习服务
云学堂平台是一个在线学习APP，为了帮助您访问云学堂平台上的课程及其它学习资源，我们需要使用您的网络（wifi或者蜂窝移动网络）。
1.3 为您提供学习社区服务
云学堂平台提供学习问答、即时通讯(IM沟通)和笔记等学习工具，当在云学堂平台使用问答、即时通讯(IM沟通)和笔记功能时，您上传的视频、图片、评论、互动等信息会存储在云学堂平台的服务器中，因为存储是实现这一功能所必需的。我们会以加密的方式存储，您也可以随时删除自己上传的信息。除非经您自主选择或遵从相关法律法规要求，我们不会对外提供上述信息，或者将其用于该功能以外的其他用途。
请注意，您在使用我们的服务时所共享的内容和信息，会涉及您的个人敏感信息。如果包含他人的个人信息，请您确认已获得他人的合法授权。请您更加谨慎地考虑，是否在使用我们的服务时披露甚至公开分享相关个人敏感信息。
1.4 为您提供基本用户学习体验
为了保证您在使用云学堂平台时的基本用户体验，您选择使用云学堂平台学习时，则需要向我们提供或允许我们收集以下设备权限与信息：
1.4.1 获取您的设备的 WLAN 连接状态，以便在云学堂平台在播放视频课程或直播需要消耗较多数据流量时，能给您及时提醒。
1.4.2 判断应用运行状态，以判断云学堂平台是否在前台运行，从而根据您的使用场景为您提供合适的通知。
1.4.3 改变音量，以方便您在观看或收听音视频课程时可以改变音量。
1.4.4 控制振动，当您未打开APP时，收到IM聊天消息或上课通知等，通过振动提示。
1.4.5 通知中心，当您有上课通知、新的IM消息时，快速得到提醒。
1.4.6 重力感应，根据手机的方向，视频和直播可以自动横屏，提升您的学习体验。
1.4.7 本地数据库写入与读取，当您观看视频课程时，可以缓存视频文件至您的手机，以便您离线时观看学习。
1.4.8 检测本机是否安装微信、QQ ，为了方便您采用微信、QQ的第三方账号登录和分享学习内容，我们使用了第三方SDK“微信分享SDK”，微信分享SDK需要监测您是否安装了相应APP，以调用微信、QQ进行分享和登录。
1.4.9 手机休眠，为了让您在学习视频过程中，避免因手机自动休眠造成学习打断，我们需要使用手机休眠功能，让视频学习过程不被休眠打断。
1.4.10 应用新版本安装提醒，为了提升您的学习体验，云学堂平台将持续进行在线升级，我们会在应用内提醒您下载和安装最新版本的APP。
1.4.11 取消推送消息，为了避免消息频繁推送，我们登陆APP后通过“我的-设置与反馈-新消息通知”设置是否推送。
1.4.12 获取安装APP列表：我们需要获取当前系统安装的APP签名与当前APP作对比，确保您的APP是官方APP，该信息只在本机存储及应用。
1.4.13 获取当前运行的APP进程列表：获取当前运行的APP进程名字与当前APP包名进行对比确保主进程执行了必要的代码，该信息只在本机存储及应用。
1.4.14 为确保您获得更为流畅、轻松的使用体验， 在您使用云学堂提供的相关服务时， 我们会通过小型数据文件“Cookie”识别您的身份， 以帮助您减少信息录入的次数和频率，或协助判断您账户的安全状况。Cookie通常包含标识符、站点名称以及一些号码和字符，借助于Cookie，网站能够存储您的偏好信息用于改善产品服务及用户体验，或及时发现并防范安全风险，为您提供更好的服务。我们不会将Cookie用于本政策所述目的之外的任何用途，您可根据自己的偏好留存或删除Cookie。您可清除软件内保存的所有Cookie，当您手动清除后您的相关信息即已删除。
1.5 为您提供客服支持
当您在使用云学堂平台的过程中遇到系统崩溃情况时，我们在经过您的同意后需要您授权读取手机状态和身份，包括手机设备类型、系统版本、MAC地址、IMEI以便快速定位并为您解决相应问题。
请注意，单独的设备信息、系统版本信息是无法识别特定自然人身份的信息。
1.6 其它附加服务
为向您提供更便捷、更优质、个性化的产品及/或服务，努力提升您的体验，我们在向您提供的以下附加服务中会收集和使用您的个人信息。如果您不提供这些信息，不会影响您使用云学堂平台的浏览、搜索、购买基本服务，但您无法获得这些附加服务给您带来的用户体验。这些附加服务包括：
1.6.1 基于相机/摄像头的附加服务：您可在开启相机/摄像头权限后使用该功能进行扫码用于登录、扫一扫、签到、拍摄照片或视频用于和其他用户之间的交流。
1.6.2 基于相册（图片库/视频库）的图片/视频访问及上传的附加服务：您可在开启相册权限后使用该功能上传您的图片/视频，以实现更换头像、更换背景、上传时刻/社区图片、在即时通讯(IM沟通)中发送图片。
1.6.3 基于麦克风的语音技术相关附加服务：您可在开启麦克风权限后使用麦克风实现和其它用户之间进行语音聊天以及语音搜索功能。请您知晓，即使您已同意开启麦克风权限，我们也仅会在您主动点击客户端内麦克风图标或录制视频时通过麦克风获取语音信息。
1.6.4 基于位置的相关附加服务：您可以在开启位置权限后获取手机GPS用于时刻、社区、签到的定位，拒绝后定位信息将受到影响，基于位置的签到功能将无法使用。
1.6.5 基于电话的相关附加服务：您可以在开启来电状态的监听权限后在音视频知识学习中避免电话来电避免影响学分记录以获得更好的学习体验。
1.6.6 基于存储的相关附加服务：您可以在开启存储权限后将课件内容缓存到本地方便后续离线学习，以及获得相关系统错误日志的记录能力。
请您理解并同意，上述附加服务需要您在您的设备中开启您的摄像头（相机）、相册（图片库）、麦克风（语音）、日历、位置、电话和存储的访问权限，以实现这些权限所涉及信息的收集和使用。您可在您的设备设置中逐项查看上述权限的状态，并可自行决定这些权限随时的开启或关闭。请您注意，您开启任一权限即代表您授权我们可以收集和使用相关个人信息来为您提供对应服务，您一旦关闭任一权限即代表您取消了授权，我们将不再基于对应权限继续收集和使用相关个人信息，也无法为您提供该权限所对应的服务。但是，您关闭权限的决定不会影响此前基于您的授权所进行的信息收集及使用。
1.7 其他
1.7.1 若您提供的信息中含有其他用户的个人信息，在向云学堂平台提供这些个人信息之前，您需确保您已经取得合法的授权。若其中涉及儿童个人信息的，您需在发布前取得对应儿童监护人的同意，前述情形下监护人有权通过本政策第九条的途径联系我们，要求更正或删除涉及儿童个人信息的内容。
1.7.2 若我们将信息用于本政策未载明的其他用途，或者将基于特定目的收集而来的信息用于其他目的，或者我们主动从第三方处获取您的个人信息，均会事先获得您的同意。
若我们从第三方处间接获取您的信息的，我们会在收集前明确以书面形式要求该第三方在已依法取得您同意后收集个人信息，并向您告知共享的信息内容，且涉及敏感信息的在提供给我们使用前需经过您的明确确认，要求第三方对个人信息来源的合法性和合规性作出承诺，如第三方有违反行为的，我们会明确要求对方承担相应法律责任；同时，我们的专业安全团队对个人信息会进行安全加固（包括敏感信息报备、敏感信息加密存储、访问权限控制等）。我们会使用不低于我们对自身用户个人信息同等的保护手段与措施对间接获取的个人信息进行保护。
1.7.3 征得授权同意的例外
您充分理解并同意，我们在以下情况下收集、使用您的个人信息无需您的授权同意，且我们不会响应您提出的更正/修改、删除、注销、撤回同意、索取信息的请求：
（1）与国家安全、国防安全有关的；
（2）与公共安全、公共卫生、重大公共利益有关的；
（3）与犯罪侦查、起诉、审判和判决执行等司法或行政执法有关的；
（4）出于维护您或其他个人的生命、财产等重大合法权益但又很难得到本人同意的；
（5）您自行向社会公众公开的个人信息；
（6）从合法公开披露的信息中收集个人信息的，如合法的新闻报道、政府信息公开等渠道；
（7）根据与您签订和履行相关协议或其他书面文件所必需的；
（8）用于维护所提供的产品及/或服务的安全稳定运行所必需的，例如发现、处置产品及/或服务的故障；
（9）为合法的新闻报道所必需的；
（10）学术研究机构基于公共利益开展统计或学术研究所必要，且对外提供学术研究或描述的结果时，对结果中所包含的个人信息进行去标识化处理的；
（11）法律法规规定的其他情形。
请知悉，根据适用的法律，若我们对个人信息采取技术措施和其他必要措施进行处理，使得数据接收方无法重新识别特定个人且不能复原，或我们会对收集的信息进行去标识化地研究、统计分析和预测，用于改善云学堂平台的内容和布局，为商业决策提供产品或服务支撑，以及改进我们的产品和服务（包括使用匿名数据进行机器学习或模型算法训练），则此类处理后数据的使用无需另行向您通知并征得您的同意。
1.7.4 如我们停止运营云学堂平台产品或服务，我们将及时停止继续收集您个人信息的活动，将停止运营的通知以电子邮件和/或站内信和/或推送通知的形式通知您，并对我们所持有的与已关停业务相关的个人信息进行删除或匿名化处理。涉及儿童个人信息的，我们会并将停止运营的通知及时告知儿童监护人。
2 我们如何共享、转让、公开披露您的个人信息
2.1 共享
我们不会与云学堂及其关联公司以外的任何公司、组织和个人分享您的个人信息，但以下情况除外：
2.1.1 在获取明确同意的情况下共享：获得您的明确同意后，我们会与其他方共享您的个人信息。
2.1.2 我们会根据法律法规规定，或按政府主管部门的强制性要求， 对外共享您的个人信息。
2.1.3 与我们的关联公司共享：您的个人信息会与云学堂的关联公司共享。我们只会共享必要的个人信息，且受本隐私政策中所声明目的的约束。关联公司如要改变个人信息的处理目的，将再次征求您的授权同意。
2.1.4 与授权合作伙伴共享：仅为实现本政策中声明的目的，我们的某些服务将由授权合作伙伴提供。我们会与合作伙伴共享您的某些个人信息，以提供更好的客户服务和用户体验。例如，在您使用云学堂平台的直播服务时，我们需要和直播服务商共享您的设备类型及系统版本，以调动相应直播功能的支持。我们仅会出于合法、正当、必要、特定、明确的目的共享您的个人信息，并且只会共享提供服务所必要的个人信息。我们的合作伙伴无权将共享的个人信息用于任何其他用途。
目前，我们的授权合作伙伴包括以下类型：供应商、服务提供商和其他合作伙伴。
我们将信息发送给在全球范围内支持我们业务的供应商、服务提供商和其他合作伙伴，这些支持包括提供技术基础设施服务、分析我们服务的使用方式、衡量广告和服务的有效性、提供客户服务、支付便利或进行学术研究和调查。
对我们与之共享个人信息的公司、组织和个人，我们会与其签署严格的保密协定，要求他们按照我们的说明、本隐私政策以及其他任何相关的保密和安全措施来处理个人信息。
2.2 转让
我们不会将您的个人信息转让给任何公司、组织和个人，但以下情况除外:
2.2.1 在获取明确同意的情况下转让：获得您的明确同意后，我们会向其他方转让您的个人信息。
2.2.2 满足法律法规、法律程序的要求或强制性的政府要求或司法裁定。
2.2.3 在云学堂或者云学堂的关联公司涉及合并、分立、收购或破产清算时，如涉及到个人信息转让，我们会在要求新的持有您个人信息的公司、组织继续受此隐私政策的约束，否则我们将要求该公司、组织重新向您征求授权同意。
2.3 公开披露
我们仅会在以下情况下，公开披露您的个人信息：
2.3.1 获得您明确同意后。
2.3.2 基于法律的披露：在法律、法律程序、诉讼或政府主管部门强制性要求的情况下，我们会公开披露您的个人信息。
3 我们如何保护您的个人信息
3.1 我们已使用符合业界标准的安全防护措施保护您提供的个人信息，防止数据遭到未经授权访问、公开披露、使用、修改、损坏或丢失。例如，数据传输过程中使用SSL加密保护；我们同时对云学堂平台提供 https 安全浏览方式；我们会使用加密技术确保数据的保密性；我们会使用受信赖的保护机制防止数据遭到恶意攻击。
3.2 我们会部署访问控制机制，确保只有授权人员才可访问个人信息；以及我们会举办安全和隐私保护培训课程，加强云学堂员工对于保护个人信息重要性的认识。
3.3 我们已经取得了信息安全管理体系认证（ISO27001）。
3.4 信息存储期限。我们会采取一切合理可行的措施，确保未收集无关的个人信息。我们只会在达成本政策所述目的所需的期限内保留您的个人信息，除非法律有强制的存留要求。而我们判断前述期限的标准包括：
3.4.1 完成与您相关的服务目的、维护相应服务及业务记录、应对您的查询或投诉；
3.4.2 保证我们为您提供服务的安全和质量；
3.4.3 您是否同意更长的留存期间；
3.4.4 是否存在保留期限的其他特别约定。
在您的个人信息超出保留期限后，我们会根据适用法律的要求删除您的个人信息，或使其匿名化处理。
3.5 互联网并非绝对安全的环境，而且电子邮件、即时通讯、及与其他云学堂平台用户的交流方式并未加密，我们强烈建议您不要通过此类方式发送个人信息。请使用复杂密码，协助我们保证您的账号安全。
3.6 我们将定期更新并公开安全风险、个人信息安全影响评估等报告的有关内容。您可通过我们的官方网站获得相关信息。
3.7 互联网环境并非百分之百安全，我们将尽力确保或担保您发送给我们的任何信息的安全性。在不幸发生个人信息安全事件后，我们将按照法律法规的要求，及时向您告知：安全事件的基本情况和可能的影响、我们已采取或将要采取的处置措施、您可自主防范和降低风险的建议、对您的补救措施等。我们将及时将事件相关情况以邮件、信函、电话、推送通知等方式告知您。难以逐一告知个人信息主体时，我们会采取合理、有效的方式发布公告或告知您所在企业。同时，我们还将按照监管部门要求，主动上报个人信息安全事件的处置情况。
3.8 在发生危害网络安全的事件时，我们会按照网络安全事件应急预案，及时采取相应的补救措施。如果我们的物理设施或技术防护措施遭到破坏，导致您的个人信息被泄露、非法提供或滥用，造成您的合法权益受损，我们将严格依照法律的规定承担相应的责任。
按照中国相关的法律、法规、标准，以及其他国家、地区的通行做法，我们保障您对自己的个人信息行使以下权利：
4.1 访问您的个人信息
您有权访问您的个人信息，法律法规规定的例外情况除外。如果您想行使数据访问权，可以通过以下方式自行访问：
您可以在「设置-账号设置」中访问您的个人资料信息以及其他数据。
4.2 更正您的个人信息
当您发现我们处理的关于您的个人信息有错误时，您有权自行或要求我们做出更正。您可以通过“4.1访问您的个人信息”，编辑您的个人资料信息、更改您的密码、添加安全信息等。
4.3 删除您的个人信息，包含：学习历史、聊天记录、个人收藏等学习数据
在以下情形中，您可以向我们提出删除个人信息的请求：
4.3.1 如果我们处理个人信息的行为违反法律法规；
4.3.2 如果我们收集、使用您的个人信息，却未征得您的同意；
4.3.3 如果我们处理个人信息的行为违反了与您的约定。
4.3.4 如果我们永久不再为您提供产品或服务。
当您从我们的服务中删除信息后，我们不会立即在备份系统中删除相应的信息，但会在备份更新时删除这些信息。
4.4 改变您授权同意的范围
每个业务功能需要一些基本的个人信息才能得以完成。对于额外收集的个人信息的收集和使用，您可以随时给予或收回您的授权同意，客户端具备撤销已同意授权的功能，用户可在设置-->权限中进行相关隐私授权的关闭，具体为：
Android手机-->设置-->应用-->权限；
IOS手机-->设置-->隐私-->权限-->应用；
当您收回同意后，我们无法继续为您提供撤回同意或授权所对应的服务，也将不再处理相应的个人信息。但您收回同意的决定，不会影响此前基于您的授权而开展的个人信息处理。
4.5 注销账户
您随时可注销此前注册的账户，您可以通过以下方式操作：线下联系您当前企业/机构的系统管理员，请求注销账号。
在注销账户之后，我们将停止为您提供产品或服务，并依据您的要求，在15个工作日内删除您的个人信息，或对您的个人信息进行匿名化处理，法律法规另有规定的除外。
4.6 约束信息系统自动决策
在某些业务功能中，我们仅依据信息系统、算法等在内的非人工自动决策机制做出决定。如果这些决定显著影响您的合法权益，您有权向我们进行咨询。
4.7 响应您的上述请求
为保障安全，您需要提供书面请求，或以其他方式证明您的身份。 我们会先要求您验证自己的身份，最长将在不超过十五天处理您的请求。
对多次重复、超出合理限度的请求，我们将视情收取一定成本费用。对于那些无端重复、需要过多技术手段（例如，需要开发新系统或从根本上改变现行惯例）、给他人合法权益带来风险或者非常不切实际（例如，涉及备份磁带上存放的信息）的请求，我们会予以拒绝。
在以下情形中，按照法律法规要求，我们将无法响应您的请求:
4.7.1 与云学堂履行法律法规规定的义务相关的；
4.7.2 与国家安全、国防安全直接相关的；
4.7.3 与公共安全、公共卫生、重大公共利益直接相关的；
4.7.4 与犯罪侦查、起诉、审判和判决执行等直接相关的；
4.7.5 有充分证据表明您存在主观恶意或滥用权利的（如您的请求将危害公共安全和其他人合法权益，或您的请求超出了一般技术手段和商业成本可覆盖的范围）；
4.7.6 出于维护您或其他个人的生命、财产等重大合法权益但又很难得到本人同意的；
4.7.7 响应您的请求将导致您或其他个人、组织的合法权益受到严重损害的；
4.7.8 涉及商业秘密的。
5 未成年人保护
虽然我们的用户不包含未成年人，但我们仍然非常重视对未成年人个人信息的保护。根据相关法律法规的规定，若您是18周岁以下的未成年人，在使用我们的服务前，应事先取得您的家长或法定监护人的书面同意。若您是未成年人的监护人，当您对您所监护的未成年人的个人信息有相关疑问时，请通过本文开头公布的联系方式与我们联系。
6 第三方服务
云学堂平台链接至第三方提供的社交媒体或其他服务（包括网站或其他服务形式）。
包括：
6.1 您可利用“分享”键将某些内容分享到其他第三方社交媒体，或您可利用第三方服务登录云学堂平台。这些功能会收集您的信息（包括您的日志信息），从而正常运行上述功能；
6.2 您通过“知识头条”功能查看新闻时，如选择接受第三方服务。将向第三方共享用户账号中头像、用户名等信息；
6.3 您使用“签到”功能时，需要收集您的手机号、验证码用于告知中奖信息。
6.4 其他接入第三方服务的情形。
在通过云学堂平台与第三方进行沟通或购买商品及服务时，您不可避免的要向交易对方或潜在的交易对方披露自己的信息，如联络方式或者邮政地址等。请您妥善保护自己的信息，仅在必要的情形下向第三方提供。
您使用第三方的服务（包括您向第三方提供的任何信息），须受第三方自己的服务条款（而非本隐私政策）约束，您需要仔细阅读其条款。本隐私政策仅适用于我们所收集的任何信息，并不适用于任何第三方提供的服务或第三方的信息使用规则，而我们对任何第三方使用由您提供的信息不承担任何责任。

我们在中华人民共和国境内收集和产生的个人信息，将存储在中华人民共和国境内。
8 本政策如何更新
8.1 我们的隐私政策适时进行修订，如该等变更会导致您在本政策项下权利的实质减损，我们将在变更生效前，通过电子邮件和/或站内信和/或推送通知的方式通知您。

本政策的生效、履行、解释及争议的解决，您因使用云学堂平台或服务而产生或与本政策相关的一切争议、权利主张或其他事项，均适用中华人民共和国法律。您与云学堂或云学堂平台发生的一切争议，应友好协商，如协商不成的，可选择提交云学堂注册所在地人民法院（即：苏州市高新区(虎丘区)人民法院）诉讼管辖。
