A. Bamboo Paper应用程序 - 最终用户许可协议
本最终用户许可协议(以下简称本“协议”)为您(安装本软件的个人和由个人代表其行事的任何法律实体)(以下简称“您”或“您的”)与Wacom Co. Ltd, 2-510-1 Toyonodai, Kazo-shi, Saitama 349-1148, Japan(以下简称“Wacom”)之间达成的协议。
您必须仔细阅读并理解本协议。点击“同意”按钮或者使用或安装本软件,即表明您同意受本协议项下条款的约束。如您不同意本协议的所有条款或不同意受本协议项下条款的约束,请在您设备上点击“取消”按钮。如您不接受本协议,您将无权安装、使用或访问本软件。

1.定义
1.1 “文档”是指针对本软件的安装和使用的用户指南和手册。
1.2 “产品”是指已获授权的硬件设备的组合,本软件设计为与之兼容。

1.3 “软件”是指由Wacom开发的应用软件“Bamboo Paper”,您能够通过该应用程序捕获硬件设备上的数据,以便您能够将其用于其它目的和在其它应用程序中使用和处理,以及Wacom向您提供或供您选择的任何上述相关更新。本“软件”并不意味着或包含任何第三方软件。
1.4 “第三方软件”是指第 5.6 条中界定的软件组件(包括开源软件)以及与之相关的任何源代码和/或文档。

2.软件许可
2.1 许可授予。根据本协议的条款和条件,Wacom特此授予您有限的、非专有的许可,以便 (a) 在单个硬件设备上使用和安装本软件的单个副本(仅以机器可读的形式);(b) 使用随软件提供的文档,以支持您对本软件的授权使用;以及 (c) 仅出于备份目的制作一份本软件的备份副本,但是应在此类备份副本上复制本软件原始版本中包含的所有商标、版权以及任何其它专有和限制性权利声明、图例标识和符号。尽管有上述规定,但如果您不满18岁,则您同意,如无父母或监护人同意接受本协议规定,我们将不会向您出售或提供本软件许可。
2.2 限制。您不会也不允许、鼓励或促使任何第三方复制或使用本软件(包括文档),除非本协议明确允许或出于灾难恢复、程序错误验证和备份目的。您不会也不允许、鼓励或促使任何第三方修改、翻译、分发、创造基于本软件的衍生作品、抵押、再许可、分许可、出借、出租或租赁本软件,或将本软件用于第三方培训、商业分时租赁或供服务局使用。您不会也不允许、鼓励或促使任何第三方对本软件进行逆向工程、反汇编或反编译,或试图确定本软件中使用或体现的任何源代码、算法、方法或技术,尽管有此项限制,但适用法律明确允许的情况除外。您不会也不允许、鼓励或促使任何第三方将软件与任何平板电脑、签名插件或本协议定义范围以外的其它设备一起使用。您不会删除或更改软件中或软件上出现的任何商标、版权或其它专有和限制性权利声明、图例标识和符号。
2.3 “出口限制”。您不得使用或以其它方式出口或再出口本软件,除非您得到您合法获取本软件的司法管辖区的法律授权。如果您在美国或从美国获得本软件,本软件不得出口或再出口到 (a) 任何美国禁运国家或 (b) 美国财政部的特别指定国民名单或美国商务部的拒绝人员名单或实体名单上的任何个人或实体。使用本软件即,您表明并保证自己并非上述任何国家指定名单上的个人或实体或者并未被列于上述名单中。您还同意,您不会将这些产品用于美国法律所禁止的任何目的,包括但不限于开发、设计、制造或生产导弹或核、化学或生物武器。
2.4 不得让与;一次性转让。在未获得Wacom事先书面同意的情况下(若无合理事由,Wacom不应抑制),您不得通过法律运作或以其它方式,对本软件或本协议下您的任何权利和责任进行转让、让与或委托。不过,当且仅当满足全部下列条件时,您可以向另一方一次性永久转让本软件连同您在本协议下所有权利:(a) 转让包括下载或预装本软件的硬件,并且包括本软件和本协议,(b) 您不得在任何媒介或计算机上保留本软件的任何副本或部分副本,(c) 接受本软件的一方阅读、理解和同意接受本协议条款。以违反本段规定的方式对您在本协议下的任何权利和义务进行的转让、让与或委托均无效。
2.5 所有权。本软件是授予许可,而非出售,仅供您在遵守本协议条款的情况下使用。Wacom 和/或其关联方或许可方保留对本软件的所有权利、权益和利益,包括本软件及其任何修改、改进、更新和衍生品的(以及与之相关的)任何和所有专利、版权、商标、商业秘密或任何其它知识产权或工业产权。Wacom 保留本协议未明确授予您的所有权利和利益,除本协议明确授予的权利外,您未获得本软件的任何其它明示或暗示的权利。

2.6 无支持服务。Wacom 并无义务根据本协议提供技术支持、维护、升级、更新、修改或新版本。

2.7 更新。Wacom 可酌情向您提供本软件的更新或升级。本协议的条款将适用于 Wacom 向您提供的用于取代、补充、修改或增强软件的任何此类更新或升级,但如果此类升级或更新附有一组单独条款,则在与本协议有冲突的情况下或在本协议之外的条款中适用这些条款。

3.保证和补救措施
3.1 有限保证。Wacom 保证,当遵照文档和本协议的使用条件使用本软件时,本软件将实质按文档所述性能运行 (a) 2 年(如果您居住在欧洲、非洲或中东),或 (b) 九十 (90) 天(如果您居住在以上地区以外的其它地区),该期限自您首次下载本软件之日起计,或者当本软件已预装到您的产品中时,则自您激活产品之日起计(“保证期”)。如在保证期内,本软件不符合前述保证,则 Wacom 应作出合理的商业努力,通过修复或更换本软件来纠正此类不符合规定的情形,且不会向您收取额外费用。若 Wacom 确定修复或更换软件不可行、投入与成果不成比例、无法在合理时间内完成或需要不合理的不便操作,Wacom 可通过适当减少或退还您所支付的任何费用,以代替修复或更换义务。
本软件不具有容错性,并且未被设计、允许或意图用于与高风险活动有关的用途。本段规定了 Wacom 在本协议项下的全部责任和义务,以及当本软件不符合前述保证时您唯一的补救措施。按照本协议,Wacom 对下述情形不作任何保证:(a) 本软件将满足您的要求,(b) 本软件将兼容本协议定义的产品以外的任何产品或在其上运行,或 (c) 本软件的任何缺陷将得到纠正,或本软件的运行将不会被中断或不会出任何错误。
本协议不包含 Wacom 对任何产品的硬件组件的保证,这些硬件组件受限于该组件的制造商或销售商提供的任何单独保证。
若该类不符合规定的情形是由于未经授权使用本软件、滥用、误用、更改、忽视或意外损坏本软件或并非因 Wacom 对本软件进行的任何维修或修改所造成的,Wacom 将不承担本段规定的保证义务。软件的更换或修复并不会延长其原始保证期。Wacom 不为第三方软件提供保证。然而,如您发现存在第三方软件造成的、或者全部或部分归咎于第三方软件的严重缺陷,Wacom 将尝试向第三方软件的许可方报告该类缺陷,以便采取可能的行动。Wacom 不保证许可方将采取任何行动以补救该类缺陷。若该类缺陷是在保证期内向 Wacom 报告的,而 Wacom 无法在该保证期内从第三方软件许可方获得该缺陷的解决方案,则 Wacom 可自行决定适当减少或退还您所支付的任何费用。

3.2 免责声明。除本协议中包含的明确的、有限的保证外,Wacom不作任何保证,并在此否认与本软件有关的所有其它任何形式的陈述和保证。根据本协议,Wacom对适销性、对特定用途的适用性、质量满意度、准确性和非侵权性,以及在履行过程中、交易过程中或行业惯例中可能产生的任何保证不作任何陈述和保证。Wacom不保证您从产品中传输的任何数据的准确性。

3.3 联系信息。有关本协议或根据本协议所需要的沟通,请联系 Wacom 客户支持中心:[http://support.wacom.com/]。

4.终止
本协议在终止前始终有效。此外,如您未能遵守本协议的任何条款,您依据本协议获得的权利和许可将自动终止并不再有效,Wacom 不再另行通知或采取行动。本协议终止后,您应停止对本软件的所有使用,并从您的计算机以及安装本软件的任何类似设备上永久性删除本软件及所有相关副本并使其无法恢复(包括您的备份副本和所有文档)。本协议终止后,第 1、2.2、2.5、3.2、4 和 5 条将继续有效。
5.一般条款
5.1 管辖法律。本协议及因本协议引起或与之相关的所有事宜均受日本国内法律的管辖,不考虑任何其它法律规则。本协议不受《联合国国际货物销售合同公约》的管辖,此处明确排除该公约的适用性。如双方存在因本协议或本软件引起或与之相关的任何纠纷、索赔或争议,此类纠纷、索赔或争议仅可在日本东京地方法院进行解决,Wacom 和您在此不可撤销地同意该法院的管辖权和上述审判地点。
5.2 责任限制。在任何情况下,任何一方均不对另一方或任何第三方在合同诉讼或侵权诉讼中或根据任何其它原则而产生的任何和所有间接、附带、特殊、后果性或惩罚性损害或因利润、收入、业务、储蓄、数据、使用损失或替代采购成本损失产生的损害负责,即使另一方已被告知可能发生此类损害或此类损害是可预见的。
各方确认,本第 5.2 条和本许可协议其它条款中的责任限制以及其中的风险分配是双方之间契约的重要组成部分,否则 Wacom 将拒不签订本协议。
尽管有上述规定,本协议中的任何规定均不限制 Wacom 在以下情形中对您的责任:(I) 因 Wacom 或其员工或代理疏忽而导致死亡或人身伤害的;或 (II) Wacom 或其员工或代理的任何欺诈行为或失职;或 (III) 代表 Wacom 做出任何故意或严重疏忽的不当行为而产生;或 (IV) 根据强制性产品责任法。

5.3 可分割性。如果本协议的任何条款被认定为非法、无效或无法执行,则将依据双方所表明的意向在可能的范围内执行此类条款,或者如果无法强制执行,则将视同此类条款剥离并从本协议中删除,本协议的其余部分仍将具有完全效力。
5.4 遵守法律。您应完全遵守所有适用的法律法规,包括有关出口法律以及您的所在地或下载或使用本软件时所在国家或地区的当地法律。在不限制前述条款的普遍性的情况下,您自己不得并且不得要求您的代表向适用法律限制或禁止的任何目的地、个人或实体出口、寄送或转移本软件或其任何直接产品。
5.5 完整协议;一般条款。本协议构成双方之间的完整协议,取代与本协议标的相关的所有之前和现时的书面或口头协议或声明。这不能解释为或不得解释为在您与 Wacom 之间建立任何合伙企业、合资企业、雇主-员工、代理或特许方-受许方关系。本协议中的任何大标题、说明或条款标题仅出于方便理解的目的插入,并不以任何方式定义或说明任何条款。任何一方对任何违约或违反本协议行为的权利主张的放弃只能以书面形式作出,并不应解释为对任何其它或后续违约或违反行为的权利主张的放弃。
5.6 纳入第三方软件,包括开源软件。下文列出的第三方软件组件,以及Bamboo Paper应用程序的设置中“关于”菜单下的“第三方许可”中提及的第三方软件组件,都将被预装或在您安装Bamboo Paper应用程序时同时安装,并可能在您运行Bamboo Paper应用程序时使用。
5.7 Wacom Inkspace Plus。您可以选用“Inkspace Plus”服务,该可选服务提供了云同步等额外功能。如您想使用“Inkspace Plus”,您可能需要接受“Wacom服务使用条款”和“隐私政策”并注册Wacom 用户身份,如下文B部分所述。此情形下,您对“Inkspace Plus”的使用将受“Wacom服务使用条款”的约束。除非激活“Inkspace Plus”,否则使用本软件在您的设备上创建的任何内容将不会被保存在“Inkspace Plus”的云端上。

5. 我们收集的信息
一般而言,我们收集的信息包含两种类型:(a) 用户信息和 (b) 使用信息。我们还会在下述情况下收集一些人士的商业账户信息和社交媒体信息。

我们可能会将这些自动收集的日志信息与我们收集的关于您的其它信息相融合。若您通过电话或传真与我们联系,我们也可能记录您的电话号码、呼叫转移、短信路由信息和呼叫类型等信息。
社交媒体信息。若您选择使用社交媒体帐户登录我们的服务,我们将收到您的姓名和电子邮件地址信息,一般情况下,还会收到您的社交媒体标识符(有时也被称为用户名)。在获得平台允许的情况下,有时我们也会收到您的个人资料图像和您与我们的社交媒体帐号的历史互动信息。我们还会监测我们的产品和服务在社交媒体网站上的用户互动情况,尤其是我们的社交媒体帐号。在遵守我们所监测的社交媒体平台之隐私政策的前提下,我们可能会收到我们的社交媒体帐号的公开互动信息(如转发、转贴、点赞和其它互动)、对我们的产品或服务的提及、有关我们的社交媒体关注者的信息,以及我们收到的私信或回复。在收到您向我们发送的私信或回复时,我们会接收并处理这些消息中的任何个人信息。例如,您提到您收到了一份生日礼物,是我们的产品,那么我们将接收该信息,并存入我们与您的支持互动记录。
我们还会使用第三方社交媒体工具查看与我们的产品和服务相关的记者和网络红人。这类工具能够为我们提供这些记者和网络红人的个人公开信息。我们会利用这些信息,向网络红人提供有关我们产品和服务的信息,考察网络红人的社交媒体资历影响,并与网络红人就我们的产品进行沟通。
其它第三方信息。我们会从支持我们“服务”的第三方收到关于您的信息,包括我们的支付处理供应商、第三方市场和我们的销售渠道伙伴。我们可能会将上述第三方提供的信息添加到我们从网站收集的关于您的信息中。

6. 我们如何使用收集的信息
我们会出于以下目的使用您的个人信息,我们相信这些用途符合您与我们及我们的“服务”互动时的期望:
• 提供“服务”和支持。我们使用您的个人信息以提供和管理我们的“服务”、就我们的“服务”与您沟通,并履行我们与您之间的任何合同义务。此外,我们使用您的个人信息以支持您对“服务”的使用,并确保“服务”的质量和安全。

All of the deliverable code in SQLite has been dedicated to the public domain by the authors. All code authors, and representatives of the companies they work for, have signed affidavits dedicating their contributions to the public domain and originals of those signed affidavits are stored in a firesafe at the main offices of Hwaci. Anyone is free to copy, modify, publish, use, compile, sell, or distribute the original SQLite code, either in source code form or as a compiled binary, for any purpose, commercial or non-commercial, and by any means.
The previous paragraph applies to the deliverable code in SQLite - those parts of the SQLite library that you actually bundle and ship with a larger application. Portions of the documentation and some code used as part of the build process might fall under other licenses. The details here are unclear. We do not worry about the licensing of the documentation and build code so much because none of these things are part of the core deliverable SQLite library.
All of the deliverable code in SQLite has been written from scratch. No code has been taken from other projects or from the open internet. Every line of code can be traced back to its original author, and all of those authors have public domain dedications on file. So the SQLite code base is clean and is uncontaminated with licensed code from other projects.
